Case Study – Boundary Dispute


This particular dispute arose when neighbours of Mr & Mrs X refused to let road workers tarmac an area of land claiming that it was theirs. Mr & Mrs Y had always considered that the land was theirs.

CGD Ltd were employed to adjudicate. In doing so we studied both sets of title deeds (which dated back to the mid 1800s), historic Ordnance Survey (OS) maps, photographs and also carried out a topographic survey. Over the course of many decades much of the physical evidence depicted on the original OS maps had changed or disappeared which proved to be a challenge. However, a key piece of evidence was found in the title deeds which referred to a ‘quick live fence’. The deeds also provided dimensions of the plot of land which helped to determine the position of the disputed boundary.

The ‘quick live fence’ was identified and surveyed along with other boundary detail. The survey was ‘overlaid’ and compared to the historic OS maps. CGD Ltd established the most likely position for the disputed boundary and positioned a marker which both parties agreed to (reluctantly).
